Thank you for using the Sehri.ai platform from Sehri ("Services" or "Platform"). These Terms of Service ("Agreement") explain your rights regarding images, text, audio, videos, and other assets that you may generate using the Services, or prompts you may input into the Platform ("Assets"), your use of the Service, and other important topics, such as arbitration. Please read carefully. Our privacy policy describes how we handle your data here. Additionally, we are committed to ensuring that all data collection and processing activities comply with the General Data Protection Law (LGPD), ensuring user privacy and data security.
This Agreement is entered into between Sehri.ai and the entity or person who agrees to these terms ("Customer", "You", or "Your") and governs access to the Platform and use of the Services by the Customer.
This Agreement is effective when the Customer is presented with this Agreement and continues to use the Services ("Effective Date") or receives or distributes Assets. These terms may be updated and presented to the Customer from time to time. Continued use of the Services constitutes acceptance of the updated terms. If you do not agree with this Agreement, stop using the Services.
Other documents referenced here may also govern the Customer’s use of the Services, including the Community Guidelines below.
AVAILABILITY AND QUALITY OF SERVICES
We are always improving the Services to make them better. The Services are subject to modification and changes, including, but not limited to, the artistic style of the Assets, algorithms used to generate the Assets, and resources available to the Customer. There are no guarantees regarding the quality, stability, uptime, or reliability of the Services. Please do not become dependent on any attributes of the Services or the Assets. We will not be liable for any damage caused by your dependence on the Service.
The Services and Assets are provided to the Customer "AS IS", WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, but not limited to, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the suitability of use or redistribution of the Assets and assume any risks associated with using the Services.
Sehri'S RIGHTS
Sehri reserves the right to suspend or prohibit your access to the Services at any time and for any reason. You may not reverse-engineer the Services or the Assets. You may not use automated tools to access, interact, or generate Assets through the Services. Only one user may use the Services per registered account. Each user of the Services may have only one account.
We reserve the right to investigate complaints or violations reported of our Terms of Service and take any action we deem appropriate, including, but not limited to, reporting any suspicious or illegal activity to law enforcement, regulatory bodies, or other third parties and disclosing any necessary or appropriate information to such people or entities related to user profiles, email addresses, usage history, posted materials, IP addresses, and traffic information.
AGE REQUIREMENTS
By accessing the Services, you confirm that you are at least 13 years old and meet the minimum digital consent age in your country. If you are old enough to access the Services in your country but not old enough to have the authority to consent to our terms, your parent or legal guardian must agree to our terms on your behalf.
Please ask your parent or legal guardian to read these terms with you. If you are a parent or legal guardian and allow your teenager to use the Services, these terms also apply to you, and you are responsible for your teenager’s activity on the Services.
Sehri tries to make its Services suitable for all ages and family-friendly, but the Assets are generated by an artificial intelligence system based on user queries. This is new technology and does not always work as expected. No guarantees are made regarding the suitability of the Assets for the Customer.
YOUR INFORMATION
When using the Services, you may provide personal information to Sehri, such as your email address, username, billing information, favorites, image outputs, and text prompts that you enter, or sample images and other files you upload to the Service. We are committed to ensuring that all data collection and processing activities comply with the General Data Protection Law (LGPD), ensuring the protection of privacy and the security of user information. Sehri explicitly states that it does not use the prompts (including system instructions associated, cached content, and files like images, videos, or documents) or responses to improve or train its models.
DATA SECURITY
Sehri.ai is committed to protecting the security and integrity of its users' information. We have implemented a number of security measures to safeguard sensitive information, including:
Encryption: We use industry-standard encryption to protect data during transmission and storage.
Access Control: We enforce strict access controls to ensure that only authorized personnel can access sensitive information.
Security Monitoring: We conduct continuous monitoring of our systems to quickly identify and respond to potential security threats.
Security Assessments: We conduct regular security assessments and penetration tests to identify and fix vulnerabilities.
While we strive to protect your personal information with strict security standards, it is important to recognize that no data transmission over the internet or electronic storage method is completely infallible. Therefore, we cannot guarantee the absolute security of your information.
WARRANTIES AND TECHNICAL SUPPORT
Service Warranties:
Sehri.ai strives to provide a stable and reliable service. However, we offer our services 'as is', without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We make every effort to ensure that the platform is available with a minimum uptime of 99%, although events beyond our control may affect this availability.
Technical Support:
We offer technical support to help our users get the most out of the Sehri.ai platform. Support is available on weekdays, from 10 AM to 6 PM (Saudia Arabia Time), through the following channels: integrated chat in the platform and email (hello@Sehri.ai). Our goal is to respond to all inquiries by the next business day.
Limitation of Liability:
Despite our dedication to maintaining a high-quality service, Sehri.ai is not responsible for losses or damages resulting from service failures or interruptions, including but not limited to data loss or loss of profits.
GRANTED RIGHTS
Sehri.ai platform is a Software as a Service (SaaS) solution that provides access to various artificial intelligences (AIs) available in the market. We guarantee that all content generated in Sehri.ai is not used for training models, both by our platform and by third-party platforms we connect to. We require high standards of security and data protection, ensuring that client information is not used for training or any other purposes that could expose their data. By using the Sehri.ai services, users are subject to the rules and terms established by the AI providers, with whom we connect via API. Below are the rights to the content generated for each integrated AI, following the policies and terms provided by their respective providers:
Users who use Sehri.ai retain the copyright to the content they generate. For Business and Enterprise plans, all content of text, audio, video, images, and other artifacts generated by the customer are the exclusive property of the customer, and Sehri does not have a license to use the content for any purpose. However, Sehri, the company owning Sehri.ai, receives a license to use this content for users in the Noob, Profesional, Advanced plans. This license, however, does not authorize the use of data or generated content for training artificial intelligence models, ensuring that client information is protected from such use."
YOUR RIGHTS
Subject to the above license, you own all Assets created by you using the Services, provided they are created in accordance with this Agreement. This excludes the enlargement of images from others, which remain the property of the original creators of the Assets. Sehri makes no representations or warranties regarding current legislation that may apply to you. Consult your own attorney if you wish to obtain more information on the current state of the law in your jurisdiction. Your ownership of the Assets you create persists even if, in subsequent months, you reduce or cancel your subscription.
PAYMENT AND BILLING
We may bill your use of the Services through a third-party payment service provider. The third-party service provider's terms of service will prevail over this Agreement in the event of a conflict.
You are free to cancel your plan at any time. We also reserve the right to terminate your access to the Service for any reason, including violation of the Community Guidelines or misuse of the Service. Any violation of the Community Guidelines constitutes a violation of this Agreement. You will not receive a refund for the current subscription period, but you will not be charged after the end of the current subscription period.
REFUND POLICY
We offer a 7-day money-back guarantee for the Noob, Professional, and Advanced plans.
If you are not satisfied with your purchase, simply contact us within 7 days of your purchase (the 7 days are counted from the day you acquired the subscription, this option is only valid for new payments and not for active and ongoing subscription payments) with your payment receipt, and we will process your request to issue a full refund.
It is important to be aware that the Refund Policy applies exclusively to the plans mentioned above: Noob, Professional, and Advanced.
Customers who purchase the Noob, Professional, and Advanced plans in a monthly or annual billing cycle will be eligible for a refund.
Please note that when the refund is made, your plan will be immediately canceled.
Processing refunds may take up to 30 business days. Sehri's team guarantees verification of the request within 1 business day for refund processing. The remaining time will depend on the card issuer’s bank.
Am I eligible for a refund?
To be eligible for a refund, make sure that:
You have the eligible plan above.
You have proof of purchase or an invoice (e.g., order number, receipt, etc.)
The 7-day period has not expired.
We also appreciate it if you inform us why you are requesting a refund: this helps us improve both our platform and our services to make your experience with Sehri.ai as comfortable as possible.
COMMUNITY GUIDELINES
Be kind and respectful to each other and to the team. Do not create images or use text prompts that are inherently disrespectful, aggressive, or abusive. Violence or harassment of any kind will not be tolerated.
Adult content or gore is not allowed. Please avoid creating visually shocking or disturbing content. Some text entries will be automatically blocked.
Do not publicly post others' creations without their permission.
You cannot use the Services to generate images for political campaigns or try to influence the outcome of an election.
Be cautious when sharing. You may share your creations outside of the Sehri community, but consider how others may perceive your content.
You agree not to use the Services:
In any way that violates any applicable national, federal, state, local, or international law or regulation;
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way;
To generate or disseminate false information and/or content with the purpose of harming others;
To generate or disseminate personally identifiable information that may be used to harm an individual.
LIMITATION OF LIABILITY AND INDEMNIFICATION
We provide the service as is, and we make no promises or guarantees about it. You understand and agree that we will not be responsible to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages, regardless of how they occur.
You are responsible for your use of the service. If you harm someone or get involved in a dispute with another person, we will not be involved.
If you knowingly infringe on the intellectual property rights of another person, and it costs us money, you will bear this cost and also the cost of potential legal fees.
INAPPROPRIATE OR OFFENSIVE CONTENT
Sehri.ai users are responsible for determining whether an Asset may potentially be inappropriate for minors, following applicable laws and taking appropriate precautions.
Any illegal or harmful use of the Platform and/or Services will result in permanent banning, removal of the content in question, and you WILL be reported to the relevant national authority.
REMOVAL REQUEST
We respect the intellectual property rights of third parties. If you believe that material found on the Services infringes your copyright or trademark, please send an alleged infringement notice to hello@Sehri.ai with the subject "Removal Request" and include the following:
Your physical or electronic signature;
Identification of the copyrighted work (or trademark) that you believe has been infringed, or, if the claim involves multiple works, a representative list of those works;
Identification of the material you believe is infringing in sufficient detail to enable us to locate it;
Adequate information to contact you (including your name, postal address, phone number, and, if available, email address);
A statement that you believe, in good faith, that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate;
A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner;
If the copyright owner’s rights arise under the laws of a country other than Brazil, identify the country.
After receiving a notice in accordance with the aforementioned, we reserve the right to remove or disable access to the accused material or disable any links to the material; notify the alleged infringing party that we have removed or disabled access to the identified material; and terminate access and use of the Services for any user who engages in repeated acts of infringement.
The procedure described above also applies in cases where you believe that material has been removed or access to it has been disabled by mistake or incorrect identification.
DISPUTE RESOLUTION AND APPLICABLE LAW
All legal claims arising from or related to this agreement (including any dispute regarding the interpretation or fulfillment of the agreement) ("Dispute") will be governed by the laws of the State of Rio de Janeiro, Brazil.
The parties will attempt in good faith to resolve any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it will be resolved through arbitration.
GENERAL TERMS
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond their reasonable control, including events of force majeure, natural disasters, terrorism, riots, or war.
This Agreement does not create any partnership or joint venture between the parties.
If any part of this Agreement is found to be invalid, illegal, or unenforceable, the remaining portions of the Agreement will remain in effect.
This Agreement does not confer any benefits to third parties unless expressly stated.
